Terms of Service

1. General Provisions
The owner of the Project-Backup.pl website and the entity providing the service is Jakub Półrolniczak, operating as an unregistered business activity, address: ul. Siedlemińska 54/10, 63-200 Jarocin, Poland, e-mail: contact@project-backup.pl (hereinafter: "Service Provider").
These terms define the rules for using the online store and purchasing license keys for the software.
2. Purchasing Licenses
Orders are accepted 24/7 via the website. Prices given are gross prices.
Payments are processed by Stripe. Order fulfillment takes place automatically after the payment is credited, by sending the license key to the Customer's e-mail address and making it available in the Customer Panel.
To use the software, it is necessary to meet the minimum technical requirements for a given application (Windows/Linux) and have access to the Internet to verify the license.
3. Complaints, Withdrawal from the contract and Returns
All complaints regarding the operation of the Service and purchased licenses should be sent to the e-mail address: kontakt@project-backup.pl. The Service Provider will consider the complaint within 14 days due to non-compliance of the goods with the contract.
According to Art. 38 point 13 of the Consumer Rights Act, the right to withdraw from a contract concluded at a distance does not apply to a consumer in relation to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal.
4. Limitation of Liability
1. The software (SQL Backup, Files Backup) is provided "AS IS". The Service Provider, acting as part of an unregistered activity, makes no warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
2. In no event shall the Service Provider be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage.
3. The User bears sole responsibility for securing their data and uses the Software at their own risk. Licenses purchased in the store are solely to unlock functionality (e.g. extending the profile limit) and do not constitute a guarantee of the Software's reliability.
4. In no event shall the Service Provider's total liability to the User for all damages, losses, or causes of action arising out of or related to the Software exceed the amount paid by the User for the purchased license or the amount of fifty US dollars ($50.00), whichever is greater.
5. Final provisions and disputes
The Service Provider reserves the right to change these terms. In matters not covered, the provisions of Polish law apply.
The consumer has the option to use extrajudicial means of dealing with complaints and redress.
